My City Connected (MCC) Terms of Service

These Terms of Service ("Terms") govern your access to and use of the My City Connected platform, including its websites, services, and community-owned infrastructure (collectively, the "Platform").

By completing in-person verification, using the Platform, or clicking to accept, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. The MCC Model: A Digital Utility

MCC is a community-owned digital utility, not a traditional social media or e-commerce platform.

• Community-Owned Infrastructure: The Platform operates as a Public Benefit Corporation in coordination with a Community Services Cooperative (CSC). A portion of fees is redistributed to local jobs and seller-designated nonprofits.
• No Extractive Commissions: Sellers retain 100% of listed sale prices. MCC revenue derives from a $1 monthly Verified Membership fee and a portion of standard payment processing fees.
• Cryptographic Sovereignty: Your account is secured by a cryptographic key pair. Your private key is generated in person and stored only by you. MCC never holds it and is not responsible for lost access.

2. Eligibility & In-Person Verification

• Verification Required: Account creation requires in-person verification at a Lighthouse Hub with valid government-issued photo ID.
• One Account Per Person: Accounts are non-transferable.
• Age Requirement: Users must be at least 18 years old.
• Verification Discretion: MCC may suspend or decline verification at its discretion.

3. Verified Membership & Fees

• Monthly Fee: $1.00 USD per month plus applicable taxes.
• Billing & Cancellation: Billed monthly in advance. Cancellation takes effect at the end of the billing cycle. No partial refunds.
• No Refunds: Digital services and memberships are non-refundable except as required by law.

4. User Responsibilities & Conduct

You are responsible for all activity under your account. You agree not to:

• Violate any law or regulation
• Infringe intellectual property or privacy rights
• Post fraudulent, defamatory, or harassing content
• Distribute malware, spam, or phishing attempts
• Operate commercial activity outside designated seller tools
• Compromise platform security or attempt unauthorized access
• Impersonate individuals or misrepresent affiliations

5. Marketplace & Transactions

• Seller Responsibilities: Accuracy, fulfillment, legal compliance, and dispute resolution.
• Payment Processing: Handled by licensed third parties. MCC does not hold funds.
• Disputes: Users resolve disputes directly. MCC may suspend fraudulent accounts.
• MCC Credits: Non-cash, non-transferable participation metrics with no monetary value.

6. Intellectual Property

• Your Content: You retain ownership while granting MCC a limited license for platform operation.
• Platform IP: MCC owns the Platform, software, and brand assets.

7. Disclaimers & Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

• No guarantee of uninterrupted or error-free service
• No responsibility for third-party services or user actions
• Limitation of liability for indirect or consequential damages
• Liability cap equal to fees paid in the past six months

8. Indemnification

You agree to indemnify and hold harmless MCC and its partners from claims arising from your use, violations of these Terms, or infringement of third-party rights.

9. Termination

• You may terminate your account at any time
• MCC may suspend or terminate access immediately for violations
• Certain provisions survive termination

10. General Provisions

• Governing Law: State of Delaware
• Arbitration: Binding individual arbitration; waiver of jury trial and class actions
• Changes: Continued use constitutes acceptance
• Entire Agreement: These Terms and the Privacy Policy control
• Severability: Invalid provisions do not affect the remainder
